DMCA Policy
Fábrica Pirotecnia Explosión respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA) and other applicable laws, we have adopted a policy of responding to notices of alleged infringement that are properly provided to us. This policy describes the information that should be present in a DMCA notice and counter-notice.
Filing a DMCA Takedown Notice
If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible via the Fábrica Pirotecnia Explosión website or services, you may notify our copyright agent as set forth below. For your complaint to be valid under the DMCA, you must provide the following information in writing:
- An electronic or physical signature of a person authorized to act on behalf of the copyright owner;
- Identification of the copyrighted work that you claim has been infringed, including a URL (i.e., web page address) of the location where the copyrighted work exists or a copy of the copyrighted work;
- Identification of the material that you claim is infringing and where it is located on the Fábrica Pirotecnia Explosión site or services, including a URL;
- Information reasonably sufficient to permit Fábrica Pirotecnia Explosión to contact you, such as your address, telephone number, and e-mail address;
- A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or law;
- A statement, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.
Failure to include all of the above information may result in a delay in processing or an invalid DMCA notice.
Filing a DMCA Counter-Notification
If you believe that your content, which was removed or disabled, is not infringing or that you have the authorization from the copyright owner, the copyright owner's agent, or pursuant to the law, to post and use the material, you may send a counter-notice to our copyright agent. When we receive a valid counter-notice, we will forward it to the party who submitted the original DMCA Takedown Notice.
- Your physical or electronic signature;
- Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or disabled;
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled;
- Your name, address, and telephone number;
- A statement that you consent to the jurisdiction of the federal court in your district of residence (if your address is in the U.S.), or if your address is outside of the U.S., for any judicial district in which Fábrica Pirotecnia Explosión may be found, and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
Please note that if you knowingly misrepresent that material or activity was removed or disabled by mistake or misidentification, you may be subject to liability for damages, including costs and attorney's fees, under Section 512(f) of the DMCA.
